DOMESTIC LICENSE CONTRACT
FOR END USERS


This is the Morris Press Cookbooks Customer License Contract which describes the company's license terms. Morris Press Cookbooks (hereinafter referred to as the Company) thanks you for selecting this product for your computer. The end user is hereinafter referred to as the Licensee.

Downloading the software or use of the material constitutes acceptance of this license under applicable law, and upon downloading the software or use of the material, you will be subject to the terms of this license. If you do not accept the terms of this license, you must not download the software.

Grant of License
The Company grants this limited license to Licensee to possess, use, and make limited copies of the software licensed here under only on the terms and conditions specifically set out in this license documentation. Licensee must comply with all the terms of this License Contract.

Term
This license is effective from the date the licensed product is received by the Licensee and shall continue in effect until Licensee ceases all use of the licensed product and returns or destroys all copies thereof. This license shall be automatically terminated upon the failure of Licensee to comply with all the terms of this License Contract.

Your Agreement
Licensee agrees that the licensed product may, at any one time, be installed only on a single computer solely for licensee's internal business, commercial, and personal purposes. Licensee may make one copy of the licensed product for archival use only, or when the copy process is an essential step in the utilization of this program. The back up copy must contain all proprietary notices and must be externally labeled to show clearly that the licensed software is the property of the Company and that use is subject to this license. You may not use the Software on a Computer Network, unless this use is explicitly agreed to by the Company in writing. A "Computer Network" is any combination of two or more terminals that are electronically linked and capable of sharing the use of a single Software program.

Except as expressly licensed herein, Licensee may not use, copy, disseminate, distribute, modify, translate, reverse engineer, decompile, disassemble, and/or create derivative works from the licensed product, sell, lease, sublicense, rent, give, lend, or in any way transfer, by any means or in any medium, the licensed product. Licensee understands and agrees that the licensed product is the valuable property of the Company and is protected by the laws of copyright, trade secrets, and contract. Licensee will use its best efforts and take all reasonable steps to protect the licensed product from unauthorized use, copying, or dissemination, and will maintain all proprietary and protective notices intact.

Limited Warranty
The Company warrants the licensed product to be free from defects in workmanship for a period of 90 days from receipt by Licensee. Workmanship is defined as the media, documentation, and associated packaging. The software program is warranted to perform substantially in accordance with the user's manual. During this period the Company will replace any defective licensed product reported to the Company by Licensee, at no cost to licensee provided that the defective product is returned to the Company at its Kearney, Nebraska, office, shipping prepaid. This service is the Company's sole liability under this warranty.

Disclaimer
The Company will in no event be liable for lost profits, incidental, or consequential damages. This constitutes the Company's sole warranty, express or implied, and licensee waives all other warranties of merchantability or fitness for a particular purpose. Because some states allow different warranty exclusions, you may wish to check with your state or local laws to determine to what extent this disclaimer applies to you.

This license may not be modified except by a written document signed by both parties and stating on its face that it is a modification or amendment of this contract. In no case shall a modification be effected by oral or written representations or advertisements, or by any purchase order or correspondence. This contract shall be governed by the Federal copyright laws of the United States of America. Save this license for future reference.
